NMBI Annual Renewal Fee Reimbursement Scheme. Terms and Conditions.

Effective Date: 1st July 2024

1. Introduction
1.1 These Terms and Conditions govern the NMBI Annual Renewal Fee Reimbursement Scheme (the “Scheme”) operated by Obsidian Healthcare.
1.2 Participation in the Scheme constitutes acceptance of these Terms and Conditions in full.
1.3 The Scheme is exclusively available to nurses and midwives who are employed by, or contracted with, Obsidian Healthcare and who meet the eligibility requirements set out herein.

2. Eligibility
2.1 To qualify for reimbursement under the Scheme, the participant must have:
2.1.1 Completed a minimum of fifty (50) shifts with Obsidian Healthcare since their last NMBI registration renewal date; and
2.1.2 Maintained full compliance with all professional and regulatory requirements since their last NMBI registration renewal date.

2.2 Reimbursement will only be considered for participants who meet all criteria at the time of submitting a claim.

3. Scope of Reimbursement
3.1 Eligible participants may claim reimbursement for the cost of their NMBI registration renewal fee.
3.2 Reimbursements shall be subject to applicable income tax, Pay Related Social Insurance (PRSI), or any other statutory deductions.
3.3 Reimbursements will be paid directly to the participant’s nominated bank account. Requests for payment by cheque, postal order, voucher, or alternative methods will not be accepted.

4. Claim Process
4.1 Claims must be submitted online via the Candidate Portal provided by Obsidian Healthcare.
4.2. Claims must be submitted within twenty-eight (28) days of the participant’s NMBI registration renewal date.
4.3 For renewals occurring at the end of a calendar month, claims may be submitted from the first day of the subsequent month, subject to the twenty-eight (28) day submission period.
4.4 Upon submission, Obsidian Healthcare will review and validate the claim. Payment of the approved reimbursement shall be made within ten (10) working days following validation.

5. Compliance Requirement
5.1 Only participants who are fully compliant with Obsidian Healthcare policies and professional registration requirements at the time of claim submission shall be eligible for reimbursement.
5.2 Any participant found to be non-compliant at the time of claim submission will have their claim rejected.

6. Scheme Modification and Termination
6.1 Obsidian Healthcare reserves the right, at its sole discretion, to modify, suspend, or terminate the Scheme at any time.

6.2 Any modification, suspension, or termination may include:
6.2.1 Alteration of eligibility criteria, reimbursement amounts, or claim procedures;
6.2.2 Suspension of payments for pending claims;
6.2.3 Introduction of alternative schemes or benefits.

6.3 Obsidian Healthcare shall have no obligation to notify participants in advance of any modifications, suspensions, or terminations, nor shall it be liable to provide compensation for any claims affected.

7. Governing Law
7.1 These Terms and Conditions shall be governed by, and construed in accordance with, the laws of the Republic of Ireland.
7.2 Any dispute arising out of, or in connection with, the Scheme shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.

8. Acceptance
8.1 By submitting a claim under this Scheme, participants acknowledge that they have read, understood, and accepted these Terms and Conditions in full.
8.2 Participants agree to comply with all applicable policies, procedures, and requirements set forth by Obsidian Healthcare relating to the Scheme.
