*Referral Programme Terms & Conditions

Thank you for your interest in the Obsidian Healthcare Recruitment Referral Programme (“Programme”). These Terms & Conditions (“Terms”) govern your participation and outline your rights, obligations, and responsibilities when submitting referrals to Obsidian Healthcare Recruitment (“Obsidian,” “we,” “us,” or “our”). Please read these Terms carefully. Participation in the Programme constitutes your acceptance of and agreement to these Terms.

1. Referrer Eligibility
1.1 Participation in the Programme is strictly limited to healthcare professionals who are currently engaged, contracted, or registered with Obsidian Healthcare Recruitment at the time of referral submission.
1.2 Referrals of individuals who have been registered, employed, or otherwise engaged by Obsidian within the preceding two (2) years from the date of referral submission are not eligible for referral bonuses under this Programme.
1.3 Referrers must be at least 18 years old and legally entitled to work in the Republic of Ireland.
1.4 Self-referrals—where the referrer and the referred candidate are the same person—or referrals made on behalf of oneself are strictly prohibited and will result in immediate disqualification from the Programme and forfeiture of any bonus payments.
1.5 Obsidian reserves the right to verify eligibility at any time and reject any referral that fails to meet these criteria without notice or explanation.

2. Referral Submission & Candidate Consent
2.1 All referrals must be submitted exclusively through the official Obsidian referral form available on our website or via a secure, authorised submission portal. Referrals submitted by any other means may be rejected.
2.2 Prior to submitting any referral, the referrer is responsible for obtaining the referred candidate’s explicit, informed consent to share their personal information with Obsidian for the purpose of recruitment and Programme participation.
2.3 Obsidian strictly adheres to the General Data Protection Regulation (GDPR) (EU 2016/679) and the Data Protection Act 2018 (Ireland), ensuring the confidentiality, security, and lawful processing of all personal data submitted in connection with the Programme.
2.4 Any misuse, improper disclosure, or unlawful processing of candidate information by the referrer may result in disqualification and legal action.

3. Candidate Registration & Compliance
3.1 Referral eligibility is contingent on the referred candidate completing the full registration process with Obsidian, including but not limited to: Garda Vetting, verification of professional qualifications and licensure, submission of clinical documentation, and compliance with all applicable health and safety and employment standards.
3.2 Obsidian reserves the right to reject or disqualify any candidate who fails to successfully complete the registration and compliance requirements within a reasonable timeframe, as determined by us in our sole discretion.
3.3 Registration activation is the official start point for counting hours worked towards referral bonus eligibility.

4. Service Hour Requirement & Placement Conditions
4.1 To qualify for the referral bonus, the referred candidate must complete a minimum of 150 hours of work shifts assigned through Obsidian within a six (6) month period from the candidate’s date of registration completion.
4.2 All placements must adhere to the Health Service Executive (HSE) standards for healthcare delivery, including compliance with workplace health and safety regulations, adherence to professional scope of practice, and applicable labour laws within the Republic of Ireland.
4.3 Only hours worked and logged through Obsidian’s official scheduling and payroll systems are eligible to count towards the referral bonus threshold.
4.4 Partial or unpaid hours, cancelled shifts, or shifts worked outside the scope of Obsidian assignments do not qualify.

5. Referral Bonus Payment & Verification
5.1 Referral bonuses will be awarded only upon successful verification that the referred candidate has completed the required registration process and minimum hours of work.
5.2 Obsidian undertakes all verification internally via payroll and scheduling records; referrers are not responsible for monitoring candidate hours or work completion.
5.3 Payment of referral bonuses will be made within 28 calendar days following successful verification but may be subject to delays caused by operational, administrative, or banking factors.
5.4 Referral bonuses are subject to statutory taxation and deductions under Irish law.
5.5 Obsidian reserves the right to withhold or reclaim bonuses if it discovers any fraudulent activity or breach of these Terms.

6. Referral Submission Requirements & Limitations
6.1 All referral submissions must be complete, accurate, and truthful. Submissions lacking essential information or containing incorrect details may result in processing delays or disqualification.
6.2 Duplicate referrals of the same candidate by multiple referrers will be awarded to the first valid submission received by Obsidian, determined by timestamp and internal records.
6.3 Obsidian reserves the right to reject or disqualify any referral for reasons including, but not limited to, breaches of these Terms, candidate ineligibility, or any suspicion of misconduct or misrepresentation.
6.4 Referrers may submit multiple referrals but must do so individually for each candidate. Bulk or group submissions will not be accepted.

7. Geographic & Legal Compliance
7.1 Candidates must reside legally and have the unrestricted right to work in the Republic of Ireland at the time of referral.
7.2 Obsidian does not provide visa sponsorship or immigration assistance as part of this Programme.
7.3 Referrals of candidates residing outside the Republic of Ireland, including Northern Ireland or other jurisdictions, are ineligible unless otherwise explicitly stated.
7.4 Obsidian operates in full compliance with Irish and European Union employment laws, anti-discrimination statutes, and data protection regulations.

8. Claiming Your Referral Bonus
8.1 Once your referred candidate has completed the required minimum hours, you must contact Obsidian by emailing enquiries@obsidianhealthcare.ie. Include your full name, contact information, and the candidate’s full name to initiate the claim process.
8.2 Obsidian will review records to confirm eligibility and communicate the outcome within 14 business days.
8.3 Failure to claim the bonus within 12 months of the candidate’s completion of required hours may result in forfeiture of the bonus.

9. General Provisions
9.1 Obsidian reserves the right to modify, suspend, or terminate the Programme or these Terms at any time without prior notice.
9.2 These Terms are governed by and construed in accordance with the laws of the Republic of Ireland.
9.3 Any disputes arising in connection with the Programme will be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
9.4 Participation in the Programme does not constitute an offer of employment for any referred candidate.
9.5 Obsidian’s decision on all matters relating to the Programme is final and binding.
